This Privacy Policy (“Policy”) explains how Underground Magnetics, Inc. (“Underground Magnetics,” “UMAG,” “we,” “us,” or “our”) collects, uses, discloses, and protects information related to your use of our websites (including umaghdd.com and subdomains), software, cloud services, mobile or desktop applications, hardware products and related features, customer support, and other services we provide (collectively, the “Services”).

By using the Services, you agree to this Policy. If you do not agree, please discontinue use of the Services.

1) What We Collect

We collect information in three ways: (a) directly from you, (b) automatically through the Services, and (c) from third parties (e.g., distributors, dealers, analytics providers).

A. Information You Provide

  • Contact details (name, email, phone, company, address)
  • Account and authentication data (username, password, role)
  • Order, warranty, RMA, and support records
  • Survey responses, demo requests, event registrations
  • Content you submit (forms, messages, attachments)

B. Information Collected Automatically

  • Device and usage data (IP address, device identifiers, OS/browser, app version, pages viewed, referring/exit pages, timestamps)
  • Cookies, pixels, SDKs, and similar technologies (see Cookies & Tracking)
  • Product telemetry (if enabled): device status/health, firmware versions, error codes, and in some workflows location data for data-logging or mapping features you opt into

C. Information From Third Parties

  • Channel partners and resellers (lead and account info)
  • Analytics/advertising tools (aggregated usage/attribution)
  • Public or enterprise sources (business contact data)

We do not knowingly collect information from children under 13. See Children’s Privacy.


2) How We Use Information

We use personal information for:

  • Provide & secure the Services: account setup, authentication, device activation, troubleshooting, customer success, fraud prevention, safety, and integrity
  • Customer operations: order fulfillment, invoicing, warranty/RMA processing, product registration, and service communications
  • Product functionality: enabling optional features such as GPS data-logging/mapping, diagnostics/telemetry, OTA updates, and firmware compatibility checks
  • Improve & develop: quality assurance, analytics, performance monitoring, usability testing, and feature development
  • Marketing (optional): sending product updates, event invites, and offers; you can opt out at any time
  • Legal/compliance: enforcing terms, protecting rights, complying with law, responding to lawful requests

We only process sensitive or precise geolocation data when you enable or provide it and only for the specific feature or purpose described.


3) Legal Bases (If You Are in the EEA/UK)

Where the GDPR/UK GDPR applies, we rely on: contract, legitimate interests (e.g., securing and improving Services), consent (e.g., marketing cookies or optional GPS logging), and legal obligations. You can withdraw consent at any time.


4) Cookies & Tracking

We use cookies, pixels, and similar tools to:

  • Remember preferences and keep you signed in
  • Measure traffic and performance (e.g., Google Analytics)
  • Understand marketing effectiveness (ad tags; no sale of personal info)

You can control cookies in your browser and (if provided) via our on-site Cookie Settings tool. Disabling certain cookies may limit some features.


5) Disclosures of Information

We share information with:

  • Service providers / processors (hosting, cloud, email, analytics, payment, logistics, customer support) under contracts that limit their use of your data to our instructions
  • Channel partners (distributors, dealers) to fulfill requests or provide localized support when you ask or it’s necessary to service your account
  • Business transfers (merger, acquisition, financing, or asset sale)
  • Legal & safety (to comply with law, protect our rights, security, and users)

We do not sell or “share” personal information for cross-context behavioral advertising as those terms are defined by the CCPA/CPRA. We do not knowingly process children’s data for targeted advertising.


6) Data Retention

We retain personal information only as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Typical retention periods:

  • Account, order, and tax/audit records: up to 7 years (or longer if legally required)
  • Support, warranty, and device service logs: up to 5 years after last interaction
  • Marketing preferences and unsubscribes: until you change them
    When retention ends, we delete or de-identify data in line with our policies.

7) Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information (access controls, encryption in transit, network monitoring, secure development practices). No system is 100% secure. If we detect a security incident affecting your data, we will investigate and notify you and/or regulators as required by law.


8) International Transfers

We are based in the United States. If you access the Services from outside the U.S., your data may be processed in the U.S. and other countries with different data-protection laws. Where required, we use appropriate safeguards (e.g., contracts with data-processing terms, where applicable standard contractual clauses).


9) Your Privacy Rights

A. U.S. State Privacy Rights (including CA, CO, CT, IA, UT, VA and others)

Depending on your state of residence, you may have the right to:

  • Know/Access the categories and specific pieces of personal information we collected about you
  • Correct inaccurate personal information
  • Delete personal information (subject to legal exceptions)
  • Opt out of the sale or sharing of personal information and out of targeted advertising (we do not sell or share as defined by CCPA/CPRA)
  • Limit use/disclosure of sensitive personal information (we use sensitive data only for the purpose you enable and do not use it to infer characteristics)
  • Non-discrimination for exercising your rights

How to exercise: email support@umaghdd.com with your request and state of residence. We will verify your identity (and your agent, if applicable) and respond within the timeframe required by law. If we deny a request (e.g., an exception applies), you may have a right to appeal; instructions will be provided in our response.

B. EEA/UK Rights (if GDPR applies)

You may have rights to access, rectify, erase, restrict, port, or object to processing, and to lodge a complaint with your local supervisory authority. Where processing relies on consent, you can withdraw consent at any time.


10) Children’s Privacy

The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information, contact support@umaghdd.com and we will take appropriate steps to delete it.


11) Communications & Marketing

You can opt out of marketing emails at any time via the unsubscribe link or by emailing support@umaghdd.com. We may still send transactional or service messages (e.g., account, warranty, safety, or security notices).


12) Over-The-Air (OTA) & Product Updates

Some UMAG products support OTA firmware or software updates. Version numbers, device identifiers, and diagnostic/error information may be transmitted to deliver compatibility checks and updates. Where required, we will request consent or provide settings to manage these features.


13) Do Not Track

Some browsers transmit Do Not Track (DNT) signals. Because there is no industry consensus, we do not currently respond to DNT. We honor opt-out choices provided under applicable state privacy laws and our Cookie Settings.


14) Changes to This Policy

We may update this Policy to reflect changes to our practices, technology, or legal requirements. We will post the updated Policy with a new “Effective date” and, where required, provide additional notice. Your continued use of the Services after an update constitutes acceptance.
